The CFA Government Relations Office (GRO) is initiating the end of its
Phase II multi-pronged approach to gain legislative support and the
Governor's approval of CFA-sponsored SB 1212 (Romero). SB 1212
protects a long-standing, hard earned and most basic labor right --
the right of due process. The CSU administration continues to actively
oppose SB 1212, and has made its defeat as the administration's top
priority. FACULTY LETTERS NEED TO BE SENT ASAP TO COUNTER THE CSU
ADMINISTRATION'S MISREPRESENTATIONS AND CONTINUING ATTACKS.

If you have not done so already, it is imperative that all CSU faculty
WRITE A LETTER to the ASSEMBLY DEMOCRATS IN YOUR AREA. (For Phase II,
CFA is targeting Assembly Democrats because we have not received a
single favorable vote by Republicans on this issue, and the Democrats
are key to SB 1212's passage.) You can find the legislator(s) in your
area by going to www.leginfo.ca.gov, click on the "Your Legislature"
icon, then type in your zip code.

LETTERS NEED TO BE SENT ASAP! FAX YOUR LETTERS -- at the absolute
latest -- BY TUESDAY, AUGUST 28TH TO THE CFA SACRAMENTO OFFICE at
(916) 441-3513. During the past week, we have received over 50 copies
of letters sent by our members, but more are urgently needed if CFA is
to gain final approval of our sponsored bill. A SAMPLE LETTER IS
LOCATED AT THE END OF THIS REPORT.

The powerful Assembly Appropriations Committee will be voting on SB
1212 on WEDNESDAY, AUGUST 29TH and GRO staff will keep you informed of
the progress of our efforts. If approved by the committee, then CFA
will initiate its final SB 1212 Phase III efforts with letters and
postcards to Gov. Gray Davis.

SENATE EDUCATION COMMITTEE APPROVES CFA-SPONSORED ACR 73

Despite continuing opposition from the CSU administration, the Senate
Education Committee on Wednesday approved CFA-sponsored ACR 73 by a
bi-partisan 11-1 vote. ACR 73 will be heard next in Senate
Appropriations Committee on Monday, August 27th.

ACR 73 directs the CSU Trustees to study its faculty hiring practices
over the past 10 years, and to jointly develop a plan with the
Academic Senate and CFA to increase the percentage of tenured and
tenure-track faculty positions to at least 75 percent (this level was
last achieved in 1994-95, but has since dropped to 66.7
percent). Additionally, ACR 73 provides that no CSU lecturers
currently employed will lose their jobs due to the implementation of
the jointly developed plan, and directs the CSU to "seriously
consider" currently employed lecturers for tenure-track positions.

Based on CSU data, in a six-year period from 1994-95 to 2000-01,
full-time student enrollment increased by 17.2 percent, while the
number of full-time tenure and tenure-track positions increased by
only 1.6 percent. This same period saw a dramatic 67.7 percent
increase in the number of full-time equivalent lecturers employed by
the CSU.

RE:SB 1212 (Romero)  CSU Faculty Due Process Rights Protections -- SUPPORT

Dear Assemblymember [LAST NAME]:

I am a faculty member at [YOUR CAMPUS], and I am writing to register
my strong SUPPORT for SB 1212 (Romero), which protects the due process
rights of California State University faculty.  SB 1212 establishes
existing law -- that was first enacted 25 years ago -- as a minimum
level of due process rights for these employees.

As you know, the right to a hearing to address grievances is one of
the basic cornerstones of labor protections. Under the 1978 Higher
Education Employer-Employee Relations Act (HEERA), numerous collective
bargaining statutes may be superseded if the negotiating parties agree
to such changes.  However, by abusing the intent of this provision,
the CSU has repeatedly attempted to weaken the due process statute
through the collective bargaining process. Most recently, the CSU
administration proposed that faculty give up their right to an
arbitration hearing for grievances addressing tenure and job promotion
decisions by administrators.

Due process rights should not be negotiable. As with other education
public employee groups who are guaranteed due process, CSU faculty
should not be placed in a position where job standards and working
conditions would have to be compromised to preserve these
long-standing statutory safeguards.

To ensure that due process is protected, I request your SUPPORT of SB
